Kalshi Supreme Court War Game — Which Investor and Operator Positions Hold Up Under Any Ruling on Prediction Markets · Executive Deck · Interactive War Game
On October 28, 2026, Utah filed felony charges against Kalshi and its two founders. DraftKings and FanDuel pulled their Utah sports contracts within two days. On October 29, Kalshi closed $1 billion at a $40 billion valuation.
Sportsbooks acted on the worst Supreme Court answer, and investors acted on the expected one. Both groups were reading the same contest, but they were valuing different games. One game exists today, and four successor games wait behind the Court's first order.
Central finding. In every contest MindCast war-games, the game changes faster than the moves inside it. A position, safeguard or commitment is worth what it keeps in the successor game, and a forecast holds only while its game holds. MindCast AI, a Predictive Game Theory Simulation firm, models that evolution directly and lets clients play their own seat through it.
How Game Evolution Drives the Forecast
Classical war games hold the board fixed and ask what an adversary might do. MindCast holds the actors' decision rules fixed and asks which game will exist next. Four mechanisms carry the method.
Cognitive Digital Twins (CDTs) replace role-players. Each opponent is a named organization modeled from its own filings and conduct, so Behavioral Economics supplies the decision rules each actor follows in practice. A state attorney general, a federal agency or a county commission responds on the board the way its conduct history says it responds.
Game evolution modeling is the core of the method. Dynamic Predictive Game Theory tracks six dimensions as each event lands. Players and forums shift, payoffs and rules change, and timing and information move.
MindCast separates four kinds of change: continuation, branching, evolution and mutation. Mutation is reserved for an exceptional, material and durable change that replaces the game outright.
The Event-to-Game Transition Contract makes evolution executable. Each consequential event maps to the successor state it creates, the moves it opens or closes and the forecasts that stay valid. After a ruling, every Simulation Prediction carries one of three statuses. A forecast stays valid at its band, needs recalibration or resolves.
Vision Functions work like preset games. Each one encodes a known structure such as a delay game, a coordination game or a lock-in game. A preset triggers when a contest's constraints and rules overlap the conditions it requires. Dynamic Predictive Game Theory combines the triggered presets into the live game, and the presets sharpen as they run across topics.
The method has a validated history. MindCast's material Simulation Predictions hit 38 times and missed 5 times through October 31, 2026, an 88% success rate on resolved calls that sets 6 partials aside. Calls that required forecasting a change in the game itself hit at 87%, matching the 89% rate on calls inside a stable game. Game evolution modeling produced about a third of all material hits, and a fixed-game model could make none of them.
The Four War Games
Each war game applies the same architecture to a different contest. Each one dates the exposures conduct can still reduce and names the successor games that wait behind the next fork. The forecasts below come from each companion as published.
OpenAI Liability: When Safety Controls Reduce Exposure and When They Become Evidence
Companion: OpenAI Liability War Game — When AI Safety Controls Reduce Exposure and When They Become Evidence · Executive Deck · Interactive War Game
Ten state forums now press claims against OpenAI. Florida and Texas named Sam Altman, and eight states filed on a shared template in October 2026. The board shows three exposures closed before any court ruled: consumer fraud, insurance and executive liability. Breadth is the only clock conduct still moves.
SP-1 · One to two states beyond the ten file against OpenAI (50%). Window: December 13, 2026.
SP-2 · Eleven to twenty-four states litigate against OpenAI (70%). Window: October 14, 2027.
SP-6 · Given a ruling, a product or nuisance claim survives in at least one court (70%). Window: the first ruling.
SP-11 · Given a ruling, claims against Altman survive in Florida or Texas (50%). Window: the first ruling.
SP-13 · A state names a frontier developer other than OpenAI (70%). Window: October 14, 2027.
Opportunity. Developers not yet named can adopt safeguards while their preventive window stays open. Risk. A safeguard adopted after a closing event documents the exposure rather than reducing it.
AI Chip Export Enforcement: When Verification Protects US Firms and When It Arrives Too Late
Companion: AI Chip Export Enforcement War Game Shows When Verification Protects US Firms and When It Arrives Too Late · Executive Deck · Interactive War Game
Super Micro's vendor clocks closed in March 2026 on an indictment and a complaint. For every US firm not yet named, ownership turns on November 10 and tenant rules turn on January 3, 2027. The financier exposure carries no closing date. The board runs as a Simulation Snapshot, so its odds print in tens.
The Bureau of Industry and Security (BIS) posts the suspension notice for public inspection (80%). Window: November 10, 2026.
The suspension is extended or narrowed rather than fully returned (80%). Window: January 10, 2027.
Remote-access authority is enacted (20%) against lapse (80%). Window: January 3, 2027.
A new export-control securities class action follows beyond Super Micro (50%). Window: December 31, 2027.
A corporate resolution reaches a major chip vendor or server maker (30%). Window: October 31, 2027.
Opportunity. Ownership maps finished before November 10 make self-disclosure a choice rather than a reaction. Risk.Verification bought after a closing date becomes an exhibit rather than a defense.
Clean Compute Anchors: When a Host's Early Move Secures Power and When the Session Sets the Terms First
Companion: Clean Compute Anchor War Game Shows When a Host's Early Move Secures Power and When the Session Sets the Terms First · Executive Deck · Interactive War Game
Grant County's cap closed the first allocation window in April 2025. Washington's 105-day session convenes January 11, 2027 and decides four clocks at once. The simulation places a nuclear-only definition as the likeliest 2027 outcome, which would leave hydro anchors outside stated criteria.
First anchor agreement at a Washington hydro or nuclear interconnection, first phase under 20 MW (45–57%). Window: December 31, 2028.
First county decision in the six regions lands on a firm-clean anchor (42–54%). Window: December 31, 2029.
Washington adopts a burden-based definition for computing at generation sites (34–46%). Window: December 31, 2027.
Given a multi-site buyer, a shared hub serves three sites before a second island (48–60%). Window: December 31, 2031.
The first commercial AI service on quantum-produced data runs on shared or remote access (64–76%).Window: December 31, 2033.
Opportunity. A host that confirms imported power before announcing shapes what the county reads. Risk. A host that announces first invites county review as a data center and rides on deposits.
Kalshi Prediction Markets: Which Positions Hold Up Under Any Supreme Court Answer
Companion: Kalshi Supreme Court War Game — Which Investor and Operator Positions Hold Up Under Any Ruling on Prediction Markets · Executive Deck · Interactive War Game
Three circuits now split on whether sports event contracts fall under federal or state authority. The board weights four branches of the Court's first order and sorts every seat by the legal layer its money needs. The board runs on a Foresight Simulation, so it prints specific probabilities with bands.
Grant on first consideration (28–38%).
A call for the Solicitor General's views (25–35%).
A hold (15–22%) or a denial (14–22%).
A grant in at least one petition by June 30, 2027 (64–72%).
A full Kalshi win through a grant and a sweep (about 11–17%), against a state win through a grant and full reversal (about 12–18%).
Opportunity. Dual-rail seats, which hold a state gaming license and a federally regulated prediction channel, keep their options under every branch. Risk. Standalone exchanges and state-only operators each depend on one answer and lose value under the others.
Across the four boards, one pattern holds. The successor game decides the value of every commitment, and the date of the closing event decides whether conduct still matters.
What the Full Publication Adds
The summary carries the finding and the headline forecasts. The full publication carries the machinery behind them.
The primary paper sets out the six departures from classical war gaming, the four-class change taxonomy and the Event-to-Game Transition Contract in full. The paper walks the OpenAI board through six dated turns and three successor states for the first product or nuisance ruling. The paper maps the three simulation depths, from Vision Statement to Snapshot to Foresight Simulation, and it reports validation by vertical with the method disclosed.
The companions add 79 Simulation Predictions across the chip (21), clean compute (17) and Kalshi (41) sets plus five carried OpenAI forecasts. Each companion also carries exposure-clock tables, five alternative moves and an interactive module.

Strongest Simulation Predictions Across the Series
The series' most decision-relevant forecasts resolve inside fourteen months. The list leads with the earliest windows.
BIS posts the chip suspension notice (80%) by November 10, 2026.
One to two more states file against OpenAI (50%) by December 13, 2026.
Remote-access authority lapses (80%) by January 3, 2027.
The Supreme Court grants a Kalshi petition (64–72%) by June 30, 2027.
Eleven to twenty-four states litigate against OpenAI (70%) by October 14, 2027.
Washington adopts a burden-based definition (34–46%) by December 31, 2027.
A first Washington clean anchor agreement signs (45–57%) by December 31, 2028.
Every Simulation Prediction carries a window, a falsifier and a named source that resolves it. The series carries 84 forecasts across the four boards, and 19 structural calls remain open across MindCast's verticals.
Stakeholder Opportunities and Risk Mitigation
Each stakeholder below faces a decision the boards date. Each entry names the decision, the opportunity and the mitigation the analysis supports.
⚖ Litigation and regulatory counsel. Counsel must decide which motions, safeguards and statements to make before the next closing event. The boards show which exposures conduct can still reduce. Risk mitigation: file preservation, co-location reopeners and label-ownership clauses before execution, because none can be added after.
💼 Executives at AI developers. Developers not yet named must choose safeguards while the breadth clock runs. SP-13 puts a second named developer at 70% by October 2027. Risk mitigation: adopt reassessment triggers now, so the evidence shows prevention rather than reaction.
🔩 Chip vendors, server makers and hosts. Firms not yet charged must decide whether to finish ownership maps before November 10. Risk mitigation: complete the 50% ownership review, audit unverifiable channels and prepare a self-disclosure decision before the suspension notice lands.
🎯 Exchanges, sportsbooks and leagues. Operators must choose which legal layer their business depends on before the Court's first order. Risk mitigation: add the missing rail early, because a licensed operator that adds a federally regulated channel moves into the group that survives every branch.
⚡ Utilities, districts and compute hosts. Hosts must decide whether to sign or wait for the January 11 session. Risk mitigation: confirm imported power before any announcement and write a reopener keyed to the definition the session adopts.
📊 Investors and lenders. Capital must be sized against the next fork rather than the last headline. Risk mitigation: rank positions by their worst branch, key terms to the outcome and treat "quantum-ready" labels as unverified until utilization appears.
🛡 Insurers and coverage counsel. Carriers must decide which AI exposures affirmative cover reaches. An insurance form edition closed an OpenAI exposure before any court acted. Risk mitigation: write conditions keyed to evidence of control and read each endorsement schedule at renewal.
🏛 Policymakers and enforcers. Legislatures and agencies must decide which rules reward prevention. Risk mitigation:reward verification adopted before a rule rather than after an indictment, and test each draft definition against models of the parties it binds.
Across every role, the same rule applies. Value sits with the party that acts before the closing event and holds its options across the successor games.
Conclusion
Utah's charges and Kalshi's $40 billion round arrived in the same week because the two sides were valuing different games. Sportsbooks valued the worst successor game, and investors valued the expected one. MindCast's war games show that both readings are partial until the successor games are mapped.
Game evolution modeling turns that gap into a dated decision. The next tests begin on November 10 and November 13, 2026, when the chip suspension notice and Nevada's responses at the U.S. Supreme Court arrive.
