On August 31, 2026, Compass declared its objective against the Northwest Multiple Listing Service "fully realized." The agreement it signed kept the rule it had sued to remove: every listing still had to be submitted to the database, now with a 21-day First Look status in front of it. Forty-six days later Compass pleaded in federal court in California that the same submission rule at the California Regional Multiple Listing Service (CRMLS) is an illegal restraint of trade.

Central finding. Compass has won concessions, not cases. In nineteen months of litigation against listing services and a portal it has produced procedural rounds, one lost injunction bid and one negotiated status, and no court has ruled for it on the merits. The institutions it targets have stopped answering one at a time. The forum, the timing and the evidence base of its disputes now sit with nine MLS plaintiffs in its home federal district, with a brokerage consortium it did not join and with statehouses that mostly chose a model Compass can live with.

How the game moved around Compass

The demand letter worked against a lone target. Compass sent identical letters on September 8, 2026 with an October 6 deadline. CRMLS sued first in the Southern District of New York on October 5. Six MLSs filed a joint complaint on October 21, OneKey joined CRMLS on October 27 and MLSListings joined the six on November 2. Against nine plaintiffs the same letter supplies the evidence that a live controversy exists.

Compass's court channel and its public channel now diverge. On October 23 its counsel told the New York court that Compass "has not decided whether to file any other cases." Its chief executive keeps promising suits against any MLS that fines its agents. Every board and every court can read both statements, and pairing them costs the reader nothing.

Four national brokerage groups launched Open Real Estate on October 26 with a one-business-day submission rule written into a brokerage agreement. A week later it held 826 letters of support, 493 of them from independent brokerages. Independents sign because private listings reward firms with large in-house buyer pools, and shared inventory gives them scale without merging. Compass's litigation reaches that coalition only weakly, because a free, voluntary agreement open to every brokerage is a poor antitrust target.

Statehouses chose the opt-out model. Washington's SSB 6091 requires concurrent public marketing with no seller opt-out. Wisconsin, Connecticut and New York's passed bill instead make public posting the default and attach a signed disclosure to every private listing. Compass avoids the strictest rule and inherits a public default it must opt out of one listing at a time, while MLS cooperation rules stay in force under every opt-out law enacted so far.

Behavioral Economics + Dynamic Predictive Game Theory explain the two sides. Compass repeats the sequence that paid once, and boards repeat the rule that kept their inventory whole. Game theory supplies the payoff: Compass's position rests on options rather than commitments, and options pay only while the governing game stays unresolved. Most rulings, launches and statutes concentrate weight on a game Compass did not choose.

What the full publication adds

The full paper runs sixteen MindCast Foresight Simulation Predictions from a Checkpoint 0 MindCast AI Proprietary Cognitive Digital Twin Foresight Simulation (MP CDT FS) with eleven Cognitive Digital Twins, plus seven entries carried from earlier MindCast papers under their original bands. The paper draws two trees: a short-horizon national contest with seven concurrent channels and a long-horizon Washington reference. Six coming events map into twelve elementary successor states and one composite state. Each state carries five entries and an inheritance table naming what it resolves, keeps, activates and reopens. The paper adds a dated threat-and-response table across seven Compass moves and three structural hypotheses. Fourteen secondary hypotheses with falsifiers and a seven-front rating of Compass's posture follow, with a risk-mitigation layer for every audience and 47 cited sources.

Two companion decks and an interactive module carry the same board. The MindCast Compass MLS Value Proposition states the offering for MLS boards and associations and for counsel and brokerages in sixteen pages: https://magazine.mindcast-ai.com/compass-mls-offensive-long-short-horizons-value-proposition. The MindCast Compass MLS War Game draws both horizon trees and Compass's six-operator move deck beside three playable seats and the thirteen states in 22 pages: https://magazine.mindcast-ai.com/compass-mls-offensive-long-short-horizons-war-game. The Interactive War Game runs the turn sequence online against an adapting Compass Cognitive Digital Twin: https://magazine.mindcast-ai.com/compass-mls-offensive-long-short-horizons-interactive-war-game.

Simulation Predictions

  • The CRMLS claims stay in the Southern District of New York, neither dismissed nor transferred, through May 3, 2027: 66–78%.

  • Compass files an antitrust complaint against at least one MLS other than CRMLS by December 31, 2026: 69–84% (carried).

  • At least 11 MLSs are plaintiffs across the two New York actions by May 3, 2027: 47–61%.

  • No state enacts a Washington-style no-opt-out statute in a 2027 session by August 3, 2027: 62–77%.

  • Compass keeps paying CRMLS fines for its agents through May 3, 2027: 72–86%.

  • Compass is not an Open Real Estate participating member bound by the one-business-day rule on August 3, 2027: 70–82%.

  • Fragmented accommodation describes the national market on February 3, 2028: 30–42%.

Every entry carries a window, a falsifier and a verification source. The paper issues sixteen entries: two primary, six secondary and eight conditional on a named event, alongside seven carried entries. MindCast's earlier Compass entries stand at seven hits, one partial and one miss on the MindCast Prediction Scorecard dated November 1, 2026.

What each stakeholder decides

MLS boards holding a demand letter. The decision is whether to join the New York action, negotiate a First Look-type agreement, defend alone if sued or keep rules without filing. Risk mitigation: prepare a joinder-ready insert and a six-month reserve before any suit, and document the rule rationale without consulting other boards.

MLS and coalition counsel. The decision is forum strategy before the ruling on Compass's planned motion to dismiss, sever and transfer. Risk mitigation: pair each Compass public statement with its court position before briefing closes, and issue holds on enforcement files and Compass correspondence.

REALTOR associations and advocacy groups. The decision is what the 2027 bills should require of members and which access language reaches a sponsor before introduction. Risk mitigation: deliver showing and offer-access language before each introduction deadline, and compare sign-in lists and amendment text across states.

Independent brokerage owners. The decision is whether to commit listing flow to Open Real Estate at vendor selection and drop private-access claims from recruiting. Risk mitigation: decide the commitment at vendor selection in the first quarter of 2027, and keep the support letter reversible until then.

Open Real Estate's founders. The decision is governance before launch. Risk mitigation: write the one-business-day rule and participant-view terms into governance documents open to every brokerage on uniform terms, and secure MLS feed agreements in Compass-heavy metros.

State legislators and committee staff. The decision is the statutory model and how to read testimony volume. Risk mitigation: request drafting that defines public marketing and showing access before hearings, and treat identical amendment language across states as a signal to verify.

Investors and analysts. The decision is how to read the securities clock apart from the MLS fight. Risk mitigation: ask for quarterly fine-payment totals on each earnings call and carry the payments as a recurring operating cost through May 3, 2027.

Conclusion

Compass called the Washington agreement "fully realized" because it holds disputes open long enough to extract a status change and then names the result a win. The sequence required a lone target, and the target population no longer stands alone. The first New York forum ruling decides how far any forecast reaches, and every board, association and brokerage holds a low-regret move before it arrives.
